Section 106

A mechanism of planning gain whereby developers make a financial contribution towards infrastructure needed to support their development. Infrastructure can include transport, schools, etc.

Section 106 is part of the Town and Country Planning Act 1990.

The legal agreement entered into by the local authority and those delivering the development is called a “Section 106 Agreement”.
